Agreement and platform terms
These Terms apply to Ever Known on iOS and Android and supplement the terms of the store or platform through which you obtain or purchase the app. By creating an account, using the service, or accepting an invitation, you agree to these Terms and applicable Apple App Store or Google Play terms.
Goodale Studios grants you a limited, personal, revocable, non-transferable license to use Ever Known for lawful personal archive and authorized viewer purposes, subject to these Terms and applicable law.
Your archive and the rights of other people
As between you and Goodale Studios, you retain ownership of original material you create and upload, subject to rights other people may have in that material. You grant Goodale Studios a limited, non-exclusive license to host, copy, transmit, format, back up, and otherwise process that material only as reasonably necessary to operate the features you authorize, protect the service, comply with law, and honor deletion or export requests.
You retain responsibility for the accuracy and lawfulness of material you add and represent that you have the rights, permissions, and legally required consent to record, upload, preserve, process, or share content involving another person. Do not record secretly where consent is required or violate privacy, publicity, intellectual-property, confidentiality, contractual, or other rights.
Family contributions must remain attributable to their contributor. Do not present another person’s statement as the archive owner’s direct memory or use Ever Known to deceive, harass, threaten, exploit, or defraud anyone.
Accounts, invitations, and permission
Keep account credentials and invitation links secure. Use only profiles and records you own or are authorized to access, and do not probe, scrape, bypass, or interfere with account, subscription, permission, rate-limit, or service protections.
A relationship, invitation, payment, or trustee role does not grant unrestricted access. The archive owner’s item-level permission applies first, including Only Me, Named People, and Never Share restrictions. Access can be revoked, and a viewer may leave a shared archive.
Never Share remains owner-only and overrides subscription, trustee status, family relationship, AI retrieval, search, summaries, direct-object requests, and viewer export. A classification may be changed only through an authorized living-owner action; no trustee or relative may make Never Share content shareable.
Trustees, legacy activation, and family disputes
A Legacy Trustee administers an activation request and does not own the profile, identity, voice, memories, or likeness. Trustee status does not permit rewriting canonical owner statements, changing Never Share classifications, authorizing synthetic voice, or accessing private material unless the owner separately granted that content permission.
Do not falsely report a death, submit fabricated verification, interfere with a living owner’s control, or use activation to gain unauthorized access. Legacy activation requires a separate reviewed workflow; Ever Known does not promise automatic death verification. Suspected false activation or identity abuse may be rejected, suspended, investigated, or reported where appropriate.
Ever Known does not adjudicate inheritance, family, estate, custody, publicity, or ownership disputes. Parties must resolve competing legal claims through appropriate agreement or legal process, and Goodale Studios may restrict access while evaluating a credible dispute or preservation request.
Basic, Premium, Ever Known AI, and subscriptions
Basic is free for owner archive creation with up to 250 MB of synchronized original media and the limited viewer experience containing only permitted Shared Essentials. Premium is $4.99/month or $39.99/year and supports preservation, up to 5 GB of synchronized original media, family and legacy workflows, portable backup, and all non-AI records already granted by an owner; it never broadens the owner’s permission.
Ever Known AI is planned at $12.99/month or $99.99/year, includes Premium, and remains Coming Soon and unavailable for purchase. Final localized prices, billing periods, trials, renewals, cancellation, refunds, and payment processing are displayed and handled by Apple or Google. Losing permission to one archive does not automatically cancel a subscription that may apply to other authorized archives. No one-time purchase tier is offered.
AI conversations are Coming Soon
Ever Known AI is planned at $12.99/month or $99.99/year and includes Premium plus AI interviews, adaptive questioning, knowledge-gap analysis, grounded conversational representation, AI organization and extraction, and separately consented synthetic conversational voice. It remains Coming Soon and unavailable for purchase. Descriptions of those capabilities do not promise a release date or current availability.
If introduced, a conversational representation will be generated software—not the person, consciousness, communication from an afterlife, or professional advice. It may be incomplete, inaccurate, or interpretive even when grounded in permitted sources, and it must not be used for medical, legal, financial, mental-health, emergency, or other high-stakes decisions.
Do not use an AI representation to exploit grief, encourage emotional dependency, displace living relationships, claim exclusive attachment, guilt a person into continued use, or market Ever Known as grief therapy or medical treatment.
Storage, export, deletion, and availability
Keep devices and accounts secure and make owner-controlled portable backups for material you cannot afford to lose. The export is intended to contain readable metadata and available original files and may be saved to iCloud Drive, Google Drive, device storage, or another owner-selected provider. Hardware failure, deletion, account loss, provider changes, corrupted storage, unavailable originals, or service interruption can still affect access. Ever Known is not a substitute for independent backups, professional recordkeeping, or estate planning.
Deleting an account or archive can permanently remove uploaded and local data after any offline request completes. Goodale Studios may change infrastructure or service providers and may improve, limit, suspend, replace, or discontinue features where reasonably necessary for security, safety, compatibility, compliance, service operation, or product development. Reasonable migration and export options will be pursued where practicable, but permanent availability or perfect preservation is not guaranteed.
Future messages, voice, and synthetic media
Original future messages must remain distinct from generated material. Delivery may depend on device, account, network, service, trustee, and verification availability, so do not rely on Ever Known as the only way to deliver legally or personally critical instructions.
Preserving a voice recording does not authorize synthetic voice creation. Do not use recordings or any future generated voice or media feature to deceive, impersonate, defraud, harass, or imply that a person said something they did not say.
Any future synthetic voice requires separate affirmative authorization and may operate only through the controlled Ever Known experience. Users and relatives may not use it for unrestricted text-to-speech, political persuasion, financial instructions, authentication, evidence, defamation, or any representation that the person actually spoke generated words.
Prohibited conduct, suspension, and termination
You may not use Ever Known for impersonation, fraud, deception, harassment, threats, defamation, illegal surveillance, non-consensual intimate material, rights violations, malicious automation, security testing without written authorization, permission bypass, false activation, or attempts to expose another person’s private archive.
Goodale Studios may reject content operations or suspend, restrict, or terminate access when reasonably necessary to address abuse, security risk, legal process, material breach, nonpayment, platform requirements, or credible harm. Where lawful and practical, account owners will be given notice and a reasonable opportunity to export their own material, but urgent safety, security, or legal situations may require immediate action.
Warranty, liability, responsibility, and contact
To the maximum extent permitted by law, Ever Known is provided as is and as available without warranties not expressly required by law. Goodale Studios does not guarantee uninterrupted availability, perfect synchronization, complete preservation, successful delivery, or the accuracy or suitability of generated, transcribed, or organized material.
To the maximum extent permitted by applicable law, Goodale Studios is not liable for indirect, incidental, special, consequential, exemplary, or lost-data damages arising from use or inability to use Ever Known. These limitations do not apply where prohibited or to liability that cannot lawfully be limited.
Where legally permitted, you agree to defend and indemnify Goodale Studios from third-party claims and reasonable costs arising from material you provided, your violation of another person’s rights, your unlawful use, or your material breach of these Terms. This does not require a consumer to waive non-waivable rights or indemnify Goodale Studios for its own unlawful conduct.
Nothing in these Terms excludes liability or mandatory consumer rights that cannot legally be excluded. Questions about these Terms may be sent to support@goodalestudios.com.
Governing law, disputes, severability, and changes
Before filing a non-urgent dispute, contact support@goodalestudios.com with a concise description so the parties can try to resolve it informally. These Terms are governed by the law applicable where Goodale Studios is principally established, without displacing mandatory consumer protections or a court’s required jurisdiction. No provision requires arbitration or waives a right that applicable law does not allow to be waived.
If a provision is held unenforceable, it will be narrowed or severed to the minimum extent necessary and the remaining provisions will continue. A failure to enforce one provision is not a waiver of later enforcement.
These Terms may change as Ever Known, its providers, law, or safety requirements change. Material changes will be posted with an updated effective date and, where required, additional notice or consent. Continued use after the effective date constitutes acceptance only to the extent permitted by applicable law.
